Terms of Use

Effective and last updated: October 4, 2026

These Terms of Use (“Terms”) govern your access to phamphysics.com and the Pham Physics student and instructor portals (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian, or through an authorized educational arrangement. A parent, guardian, instructor, or organization that authorizes a minor’s use is responsible for that authorization and for supervising the minor’s use.

2. Accounts

Provide accurate information, keep your credentials confidential, and promptly update information that changes. You are responsible for activity under your account. You may not share credentials, impersonate another person, create an account for someone without authority, or attempt to bypass access controls. Use the online Privacy Request form if you suspect unauthorized access.

3. Educational purpose and no guarantee

Pham Physics provides educational content, simulations, quizzes, and practice tools. It is not a substitute for instruction from a qualified teacher, institution-specific guidance, or professional engineering, safety, medical, legal, or financial advice. Educational materials and automated feedback may contain errors. You remain responsible for checking work and following the requirements of your instructor or institution.

We do not guarantee any grade, test score, course credit, admission result, certification, or other academic outcome.

4. Acceptable use

You may use the Service only for lawful educational purposes. You may not:

  • Disrupt, overload, probe, scan, or compromise the Service or another user’s account.
  • Access data, courses, administrative functions, or systems without authorization.
  • Use automated scraping, bots, or bulk-download tools except with our written permission.
  • Upload malware, unlawful material, or content that infringes another person’s rights.
  • Copy, sell, sublicense, publicly distribute, or create a competing service from protected Service content except as law expressly permits.
  • Use answers, feedback, or platform features to facilitate academic dishonesty or violate an instructor’s rules.
  • Misrepresent results, ownership, affiliation, identity, or authorization.

5. Instructor responsibilities

Instructors must have authority to access the students, sections, and course information associated with their accounts. Instructors are responsible for their submitted materials, assignment decisions, grading decisions, student invitations, and compliance with institutional policies and applicable student-privacy requirements. Instructors may not use student information for unrelated purposes or disclose it without authorization.

6. Content and intellectual property

The Service, including its software, design, lessons, graphics, simulations, and original materials, is owned by Pham Physics or its licensors and is protected by intellectual-property law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended educational purpose.

You retain ownership of content you lawfully submit. You grant Pham Physics a non-exclusive license to host, store, reproduce, process, display, and distribute that content only as reasonably needed to operate, secure, improve, and provide the Service. You represent that you have the rights and permissions needed to submit it.

7. Third-party resources

The Service may link to or load third-party libraries, websites, resources, simulations, or materials. We do not control those services and are not responsible for their availability, accuracy, security, or practices. Your use of a third-party service may be governed by separate terms.

8. Fees, payments, and refunds

Pham Physics does not currently process real payments. The present checkout is a clearly marked demonstration and does not collect payment-card details. Before paid services are enabled, applicable prices, billing terms, cancellation terms, and refund rules shall be displayed before purchase, and these Terms shall be updated as needed. Instructor or promotional codes may be subject to eligibility, usage, and expiration limits.

9. Suspension and termination

You may stop using the Service at any time and may request account deletion as described in the Privacy Policy. We may restrict, suspend, or terminate access if you violate these Terms, create risk or harm, fail to meet eligibility requirements, or if operation of the Service is discontinued. Where practical and appropriate, we shall provide notice and an opportunity to address the issue.

10. Service changes and availability

We may add, remove, or change features and content. The Service may occasionally be unavailable because of maintenance, faults, security events, or circumstances beyond our control. We do not promise uninterrupted or error-free operation.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Pham Physics disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Pham Physics and its operators, contributors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, opportunities, or goodwill, arising from or related to the Service. Pham Physics’s aggregate liability for claims relating to the Service shall not exceed the greater of the amount you paid directly to Pham Physics for the Service during the 12 months before the event giving rise to the claim or 100 US dollars.

Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply to you.

13. Indemnity

To the extent permitted by law, if you use the Service on behalf of an organization or as an instructor, you agree to defend and indemnify Pham Physics against third-party claims, damages, and reasonable costs arising from your submitted content, your unauthorized handling of student information, or your material violation of these Terms. This section does not apply where prohibited by law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be brought in a state or federal court with jurisdiction in Texas, and each party consents to that court’s jurisdiction and venue. This does not deprive a consumer of non-waivable rights under the law of the consumer’s residence.

15. Changes to these Terms

We may update these Terms as the Service or applicable requirements change. We shall post the revised Terms and update the date above. When required, we shall provide additional notice or seek renewed agreement. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.

16. General

These Terms and the Privacy Policy are the agreement between you and Pham Physics concerning the Service. If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer these Terms in connection with operating or reorganizing the Service.

17. Contact

Questions about these Terms may be submitted through the online Privacy Request form.
